1. Acceptance of Terms
Welcome to WorkFence Inc. ("WorkFence", "we", "us", or "our"). By registering an account, generating an API key, accessing our APIs (including Courses, Skills, Roles, Certificates, and Companies data feeds), or using our developer tools, you enter into a legally binding agreement to abide by these Terms of Service.
If you are entering into these terms on behalf of a company, enterprise, or legal entity, you represent and warrant that you have full legal authority to bind that entity.
2. API License & Access
Subject to your compliance with these Terms, WorkFence grants you a worldwide, non-exclusive, non-transferable, non-sublicensable, revocable license to access and query WorkFence API endpoints solely to integrate education, skills taxonomy, and career data into your software applications.
3. Account & API Key Security
You are responsible for maintaining the confidentiality of your account credentials and API keys. Any API requests made using your API key will be deemed authorized by you.
- API keys must never be committed to public code repositories or client-side web browser bundles.
- You must immediately notify WorkFence upon discovering any unauthorized use or compromise of your API key.
- WorkFence reserves the right to rotate or revoke compromised API keys immediately to safeguard platform integrity.
4. Acceptable Use & Restrictions
When using WorkFence APIs, you expressly agree NOT to engage in any of the following prohibited activities:
- Bypassing Controls: Attempting to circumvent rate limits, authentication safeguards, or API quota counters.
- Malicious Interference: Sending automated scripts, DDOS flooding, or introducing viruses, worms, or payload exploits into WorkFence infrastructure.
- Unlawful Processing: Utilizing WorkFence APIs to process illegal content or violate applicable data privacy frameworks.
5. Rate Limits & SLA
API endpoints are subject to tier-based rate limits (e.g., Requests Per Minute and Monthly Call Quotas) as defined in your subscription plan. Exceeding assigned limits will result in HTTP 429 ("Too Many Requests") status codes.
WorkFence targets a 99.9% uptime SLA for paid production tiers. SLA credits for eligible service outages are governed by our underlying enterprise agreements.
6. Intellectual Property Rights
WorkFence retains all right, title, and interest in and to the WorkFence APIs, schema definitions, taxonomy mappings, data processing algorithms, trademarks, and documentation. You retain all ownership rights to your proprietary software applications.
7. Payment & Subscriptions
Paid plans are billed on a recurring monthly or annual basis. Fees are charged in advance on the billing cycle start date. Failure to process payment may result in temporary API access restriction.
8. Termination & Suspension
You may terminate your account at any time via the developer dashboard. WorkFence reserves the right to suspend or terminate API access immediately in cases of material breach of these Terms, non-payment, or security abuse.
9. Limitation of Liability
To the maximum extent permitted by applicable law, WorkFence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues resulting from your use of or inability to use the API platform.
10. Governing Law & Contact
These Terms shall be governed by and construed in accordance with applicable corporate laws without regard to conflict of law principles.
